ACCIDENT WAIVER AND RELEASE OF LIABILITY

By signing up for our #GIRLGETAFTERIT - In Real Life Community, you agree to the following:

1.I hereby assume all of the risks of participating in any/all activities associated with this organization, including by way of example and not by limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

2. I certify that I am physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons that may preclude my participation herein.

3. I acknowledge that this Accident Waiver and Release of Liability Form (the “Waiver”) will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.

4. In consideration of my entry and acceptance thereof, I hereby take the following action for myself, my executors, administrators, heirs, successors, and assigns:

(A) I understand and acknowledge that though this event may make reference to #GIRLGETAFTERIT, it is not organized, offered, held, or sponsored by CASSIDY WENDELL, LLC d/b/a #GIRLGETAFTERIT

(B) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, the following entities or persons: CASSIDY WENDELL, LLC d/b/a #GIRLGETAFTERIT, and/or its members, directors, officers, employees, volunteers, Community Leads, representatives, and agents, Cassidy Wendell, and/or the activity holders, sponsors, and volunteers (collectively, the “Releasees”); and

(C) INDEMNIFY AND HOLD HARMLESS the Releasees from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of the Releasees or otherwise.

5. I acknowledge that the Releasees and their directors, officers, volunteers, representatives, and/or agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

6. I acknowledge that these activities may involve a test of a person's physical and mental limits and, though unlikely, carries with it the potential for death, serious injury, and/or property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for volunteers.

7. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

8. I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT BY ACCEPTING THESE AGREEMENTS I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

NOTICE OF FILMING AND PHOTOGRAPHY AND RELEASE

CASSIDY WENDELL LLC and/or CASSIDY WENDELL LLC d/b/a #GIRLGETAFTERIT (collectively, the “Company”) may photograph or otherwise record events hosted by the Company. By entering the event premises and participating in this event, you consent to interview(s), photography, audio and/or video recording, and its release, publication, or reproduction to be used for promotional purposes, social media, advertising, web casts, and/or inclusion on websites and/or blog posts, or any other purpose by the Company and its affiliates and representatives. Images, photos, and/or videos may be used to promote future Company events, highlight the event, and/or market the Company’s services. You hereby release the Company, its members, employees, and each and all persons involved from any liability arising from or related to the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video, and/or sound recordings.

By entering the event premises and participating in this event, you waive all rights you may have to any claims for compensation and/or royalties in connection with the use, exhibition, and/or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, and/or other publication regardless of whether you paid a fee for admission hereto. You further waive any right to inspect or approve any photo, video, and/or audio recording taken by the Company or the person or entity engaged by the Company for such purpose. You have been fully informed of your consent, waiver of liability, and release before entering this event and hereby agree to the terms set forth above.
